The chairman of the Senate Commerce Committee submitted on Thursday an already-approved cybersecurity bill to be considered as an amendment to next year’s National Defense Authorization Act.

If the amendment manages to stay intact as Congress prepares to approve the 2014 NDAA, Sen. Jay Rockefeller (D-West Virginia)’s Cybersecurity Act of 2013 may finally be codified into law.

Sorry, Mr. President. A US Federal judge has clarified a decision made last month with some news sure to upset the Obama administration: the White House cannot use the NDAA to indefinitely detain American citizens.

Judge Katherine B. Forrest has answered a request made by US President Barack Obama last month to more carefully explain a May 16 ruling made in a Southern District of New York courtroom regarding the National Defense Authorization Act. Clarifying the meaning behind her injunction, Judge Forrest confirms in an eight-page memorandum opinion this week that the NDAA’s controversial provision that permits  indefinite detention cannot be used on any of America’s own citizens.

Last month Judge Forrest ruled in favor of a group of journalists and activists whom filed a suit challenging the constitutionality of Section 1021 of the NDAA, a defense spending bill signed into law by President Obama on New Year’s Eve. Specifically, Judge Forrest said in her injunction that the legislation contained elements that had a “chilling impact on First Amendment rights” and ruled that no, the government cannot imprison Americans over suspected ties with terrorists.

“In the face of what could be indeterminate military detention, due process requires more,” said the judge.

House Approves Amendment To Limit Pentagon Drones Spying On Americans

The House of Representatives has approved an amendment to the draconian National Defense Authorization Act (NDAA) that will limit the Department of Defense from using data collected by unmanned spy drones against Americans.

The Amendment, introduced by Congressman Landry (R-LA), will prohibit information collected by DoD drones without a warrant from being used as evidence in court.

The amendment, was approved early Thursday afternoon along with 19 other en bloc amendments, reads:

“Notwithstanding any other provision of law, information acquired by an unmanned aerial vehicle operated by the Department of Defense may not be admitted in a Federal court, State court, or court of a political subdivision of a State as evidence against a United States citizen unless such information was obtained by such unmanned aerial vehicle pursuant to a court order.”

Utah asks for repeal of NDAA’s indefinite detention provisions

Utah is now the latest state to draft legislation specifically condemning the provisions in the National Defense Authorization Act that allow the president to indefinitely detain American citizens without charge.

The Utah House is currently considering legislation that would publically put down Congress for drafting the National Defense Authorization Act for Fiscal Year 2012, or the NDAA. The United States House and Senate passed the NDAA late last year before sending it to the White House for President Barack Obama to approve on December 31, 2011. Although the legislation legitimizes the use of funds for the US military to spend throughout 2012, it also includes some controversial provisions that grant the Executive Branch the power to indefinitely detain Americans considered terrorists in the eyes of the government.

Unfortunately, how the government goes about defining a terrorist is vaguely explained, which has many Americans concerned that they could someday find themselves forever behind bars in a military prison for expressing discontent with their country.

“Our concern is in the definition of ‘terrorist,’ ” Dalane England of the Utah Eagle Forum tells the Salt Lake City Tribune.

Should the government deem an American a terrorist and apply the punishments permitted through the NDAA, alleged criminals could be condemned to a shadow prison, such as the one at Guantanamo Bay, until their death.

Todd Weilier, a Republican senator representing the Woods Cross district of Utah, adds to the paper that other legislation with good intentions have been used in the pass to implement harsh punishments on Americans that are otherwise undeserving of such. “I have a legitimate fear this National Defense Authorization law will do the same thing,” says the senator, who is sponsoring the bill, formally called the ‘Concurrent Resolution on the National Defense Authorization Act.’

“It is indisputable that the threat of terrorism is real and that the full force of appropriation and constitutional law must be used to defeat this threat,” reads the bill proposed in the Utah House. “However,” it continues, “winning the war against terror cannot come at the great expense of mitigating basic, fundamental, constitutional rights.”

NDAA Nullification Passes Virginia Senate by a Veto-Proof 39-1 Vote

The Virginia Senate took a firm stand in support of liberty, the Constitution for the United States, and the Constitution of Virginia by voting in favor of House Bill 1160 (HB1160), the “NDAA Nullification Act.”

The final vote was 39-1.

After a motion to recommit (delay until next year) went down to the wire before being rejected yesterday (report here), groups across the political spectrum activated in support of the legislation, which codifies in law that no agency of the Commonwealth of Virginia – including defense forces and national guard troops, will comply with or assist the federal government in any way under it’s newly claimed powers to arrest and detain without due process.


The bill’s primary sponsor, Delegate Bob Marshall, had this to say in support:

“During World War II, the federal government incarcerated tens of thousands of loyal Japanese Americans in the name of national security. By this bill, Virginia declares that it will not participate in similar modern-day efforts.

Even President Obama had questions about the bill, when he promised the American people that he would not use the unrestrained powers it granted him — but why should we trust any President with such powers?

There are moments in our history when our liberties hang in the balance. This is one of those moments. I urge the Senate…to lead the way in the nation to ensure that Virginia will not cooperate when the Federal Government strays off the reservation with laws that take away the civil liberties of our citizens.”

FEMA Camps for the American People

Numerous FEMA camps scattered across the country are not designed to temporarily hold displaced citizens during natural disasters as the government would have us believe. Despite the denial and dismissal of the corporate media – most notably Glenn Beck – the camps are intended for the real enemy of the government and its banker overlords: the American people.

In the above video, Alex also spotlights rendition facilities located at the Robert Mueller Airport in Austin, Texas, the Sand Point FEMA rendition hub in Washington state, and the notorious site at Pier 57 in New York City.

The LAX hub is especially pertinent as the military and LA cops engage in Posse Comitatus busting exercises this week. “The LAPD said the purpose of the training was in part to ensure the military’s ability to operate in urban environments,” CBS Los Angeles reported on Wednesday.

CBS, of course, did not draw any conclusions after it reported that military helicopters staged from Dodgers Stadium and ferried back and forth from local parks in the city. Sports stadiums have historically served as impromptu prisons for military dictatorships. (Editor’s note: see this article. Miami is attempting to use stadiums to house the homeless, thus setting a precedent.)

The government has conducted a number of beta tests over the years in preparation for mass arrests and ultimately extraordinary renditions to black site torture dungeons.
